In a collective announcement, 21 municipalities and three districts have decided to take legal action against the expansion of the Department of Corrections (DOC) in Ochtrup, Germany. The decision, made by the governing bodies of these entities, aims to halt or delay the controversial expansion project.

At the heart of the controversy is the massive expansion of the DOC from 11,500 to over 19,000 m² of sales area. Critics argue that the impact assessment for the expansion project underestimates the impacts of the DOC and does not sufficiently consider the current and future development of online retail.

Ochtrup and the district of Steinfurt are among the municipalities involved in the legal challenge. Ochtrup will file a formal control application against the construction approval decision and lodge an appeal against the building plan. The surrounding municipalities, including Nordhorn, share the same concerns and plan to fight the implementation of the DOC expansion project in court.

Thomas Berling, the mayor of Nordhorn, emphasizes the need to protect functioning structures, such as the successful city center of Nordhorn. The IHK has conducted studies showing the current good shape of the shopping city of Nordhorn. However, the critics fear that the expanded DOC may affect the surrounding municipalities' infrastructure, resources, or community.

The regional exchange participants agree that the expansion project poses a threat to all city centers and local cores facing challenges such as online retail and must be defended against together. The municipalities have not specified the exact nature of their legal action against the DOC expansion, but they are preparing to file a norm control application against the building plan and an appeal against the building permit.

The legal proceedings are expected to be initiated soon, but the exact timeline is unknown. This development is a significant one in the ongoing debate about the expansion of the DOC in Ochtrup, as the municipalities jointly oppose the massive expansion due to lack of regional compatibility. As a smaller medium-sized center, Ochtrup significantly exceeds its medium-sized supply mandate with the expanded DOC, according to the critics.
