Charges against five minors in the Zara case can be imposed, according to Saifuddin
In a recent development, the police in Malaysia have announced the reopening of investigations into the deaths of two students, Wan Ahmad Faris Wan Abdul Rahman and Zara, who passed away under mysterious circumstances in 2013 and 2021 respectively.
The five students, who were charged in connection with these incidents, were initially accused of conspiring together. The charges were brought forth in the Children's Court, Kota Kinabalu, Sabah, under Section 507C(1) of the Penal Code and read alongside Section 34 of the same act.
In the case of Wan Ahmad Faris, the student was believed to have been killed at a tahfiz school in Kok Lanas, while Zara passed away at Hospital Queen Elizabeth I on July 17 after being found unconscious near the school's hostel on the morning of July 16.
Saifuddin, the Minister of Home Affairs, confirmed that the police will reopen the investigation into both cases. He also mentioned that there is no issue with reopening the investigation as the case files are already prepared.
The charges against the five students could result in imprisonment for up to a year, a fine, or both, if found guilty. However, a plea bargain in such a case is common.
The charges against the students are said to involve the use of abusive language towards a student in Form One, which was allegedly heard by the victim, causing them distress.
In 2013, the deputy public prosecutor had classified the case involving Wan Ahmad Faris as no further action (NFA). However, Saifuddin has stated that the family of Wan Ahmad Faris has expressed a possibility of reopening the case, and the police will cooperate with them.
The police have also stated that they have no issues with reopening the case investigation as the files are complete. Afnan Hamimi Taib Azamudden (PN-Alor Setar) asked whether the charges could be amended if new evidence is found in the investigation of the student's death in Form One. No immediate response was given to this question.
