Commission Lacked Compliance with Obligations Stipulated by Article 85 (1) of the Treaty, According to the Court of Justice Ruling
In a recent development, the Federal Court of Justice in Germany has rejected the appeals of both a 59-year-old man and his 60-year-old co-defendant. The appeals were against the verdict of the Dessau-Roßlau Regional Court, which found the man guilty of premeditated murder and sentenced him to life imprisonment.
The crimes, which involved the highly toxic plant known as Blue Monkshood, were committed in Dessau-Roßlau, as determined by the Regional Court. The man was found to have mixed parts of the poisonous plant into his wife's food, leading to her untimely death in a hospital in April 2023.
The co-defendant, who was involved in a longer extramarital relationship with the man before the trial, was sentenced by the Regional Court to a prison term of two years and six months. The co-defendant was found guilty of attempted coercion and failure to report a planned crime, as they repeatedly pressured for a divorce and threatened to reveal the relationship.
The spokesperson for the Federal Court of Justice announced the rejection of the appeals, stating that they were unfounded. The verdict by the Dessau-Roßlau Regional Court has now become final, marking the end of a long legal process.
This case serves as a stark reminder of the consequences of such heinous acts and the importance of upholding justice. Both the defendant and the co-defendant will serve their sentences in prison, marking a tragic end to a life taken unjustly.
