Short-lived Gambling Bill in Florida's Legislative Session* The comprehensive gambling proposal, HB1467, hoped to tackle issues like increasing penalties for illegal gambling and athlete bribery, barring gaming regulators from future employment in the industry, and legalizing daily fantasy sports* However, the bill was axed in the final week of the legislative session, leaving the Florida racing industry heaving a sigh of relief

The curtain has fallen on Florida's 2025 legislative session, and with it, so have the hopes of passing the comprehensive gambling proposal, HB1467.

Introduced in February by Florida Reps. John Snyder (R-Palm Beach) and Adam Anderson (R-Pinellas), HB1467 had ambitious goals, such as:

  • Making illegal gambling and athlete bribery third-degree felonies
  • Banning former Florida Gaming Control Commission employees from working in the state gaming industry for two years
  • Establishing formal regulations for daily fantasy sports
  • Decoupling Tampa Bay Downs and Gulfstream Park (Florida's two operational thoroughbred tracks) from live racing, thus allowing them to offer additional gambling activities like slots and poker

The bill made its way through the House, but it failed to reach the Senate floor despite being referred to the Senate Rules Committee on April 28.

The bill's demise has been welcomed by the thoroughbred industry, which believes decoupling was the final blow to harness racing in the state.

Despite the extension of the regular session until June 6 to complete an unapproved budget, gambling matters won't be squarely on the legislative agenda.

The Aftermath of HB1467's Oblivion

Sweepstakes Casinos and Digital Gaming: Keep Calm and Carry On

With the failure of HB1467 and SB1404, the two bills aimed at regulating illegal gambling and daily fantasy sports, sweepstakes casinos and digital gaming platforms can continue their operations within the Sunshine State for the time being.

Empowering Economic Freedom and Innovation

Industry groups like the Social and Promotional Games Association (SPGA) have hailed the failure of these bills as a significant victory for economic freedom, innovation, and consumer choice. By avoiding overly restrictive legislation, Florida can provide a dynamic and competitive landscape for the digital gaming sector to flourish.

Steering Clear of Expanding the Tribal Gambling Monopoly

Tribal gaming interests have been thwarted by the failure of several bills that aimed to bolster the Seminole Tribe’s exclusive gaming rights. In the absence of any legal changes, the tribal gambling monopoly remains unaltered, preserving competition from non-tribal sweepstakes operators.

Delayed Pursuit of Illegal Gambling Enforcement

Stronger tools for combatting illegal gambling enterprises would have been offered through HB1467, with a clear intent to target "bad actors." The bill's failure means that legislative clarifications and more effective enforcement strategies will be delayed.

On the Horizon

Life After the Bill

Although HB1467 has been withdrawn in the 2025 legislative session, stakeholders believe these gambling-related issues will be reintroduced in future sessions. The industry’s successful advocacy against restrictive bills may embolden digital platform operators, while proponents of stronger controls will likely continue pushing for new regulations or compact renegotiations.

The National Trend Influence

The pattern of anti-sweepstakes and restrictive gambling bills failing in other states like Arkansas, Maryland, and Mississippi suggests that Florida may lean towards a more liberal regulatory environment for digital and sweepstakes gaming in subsequent policy discussions.

In essence, the fall of HB1467 has left the digital gambling and sweepstakes industry thriving in Florida for now. The delay in expanded legal enforcement against illegal gambling operations and the possibility for future debates on these matters offer a complex backdrop for Florida's gaming scene in the years ahead.
