Former president Martin Vizcarra's legal representative refutes claims he used a mobile phone within the Barbadillo prison and asserts that Vizcarra has no intentions of evading justice.
Martin Vizcarra, the former president of Peru, is set to be released from Barbadillo prison on September 4, following the revocation of his preventive detention by the Third National Penal Chamber. The decision comes after Vizcarra was being investigated for alleged bribery during his tenure as governor of Moquegua.
The controversy about Vizcarra's communication from prison arises on the eve of his release. Erwin Siccha, Vizcarra's lawyer, confirmed that Vizcarra only communicates through public telephones within the Barbadillo prison. However, the social media posts of the former president have raised questions about how he is managing his accounts while incarcerated. Siccha clarified that there is a person in charge of managing Vizcarra's social media accounts.
The release follows the decision of the Third National Penal Chamber to revoke 5 months of preventive detention imposed on Vizcarra. The tribunal pointed out that the request for preventive detention was presented outside the procedural deadline, affecting the right to defense. This decision has sparked reactions from Congress, with some members commenting, "They put you in jail and then they correct it."
Vizcarra served only 20 days of preventive detention in the Barbadillo prison. Prior to his detention, he wrote a message saying, "I will resist from the place they send me, but they will not defeat me." The former president announced his release on his official social media accounts, stating, "Justice has been done." His brother also celebrated the news, stating, "Finally, justice did what was right."
The investigation into Vizcarra involves two major projects: Lomas de Ilo, valued at over 300 million dollars, and the Regional Hospital of Moquegua, for 120 million soles. According to the Public Prosecutor's Office, Vizcarra would have received illegal payments and bribes through intermediaries and offshore structures. However, no new information has been provided about how Vizcarra communicates from prison or whether he will face further charges.
Despite the ongoing investigation, the release of Vizcarra has raised questions about the Peruvian justice system and the length of preventive detention in such cases. As Vizcarra prepares to leave Barbadillo prison, the debate about his innocence and the fairness of the judicial process is likely to continue.
