Illegal Firework Distribution: Two Berlin Residents Convicted for Possessing and Distributing 200 Kilograms of Fireworks
In a recent ruling by the Berlin Regional Court, a 35-year-old man was sentenced to six months in prison, suspended, for violating the Explosives Act and the Weapons Act. The conviction stems from an incident involving the illegal possession of pyrotechnics, specifically ball bombs and large firework bombs, which were found in a private apartment in Berlin-Spandau.
The apartment search was conducted following a tip from the defendant's private sphere on December 18, 2024. The Berlin police seized approximately 200 kg of pyrotechnics from the apartment, which included 14 ball bombs and 800 pieces of large firework bombs. These special firework bodies, not approved for general use in Germany, were found in the dining room and hallway of the apartment.
The defendant, a previously unconvicted truck driver and father of two, had not paid for the pyrotechnics before acquiring them. He purchased the pyrotechnics for approximately 500 euros in the Czech Republic. The defendant's lawyer confirmed that he had attempted to obtain a fireworks license, but the person who previously applied for a fireworks license and owned the illegal stash has not been publicly identified.
The verdict read, "First comes the permit, then comes the noise." The defendant expressed remorse for his actions following the incident. Despite this, the public prosecutor demanded a sentence of seven months on probation, while the defense attorney requested a lenient sentence but did not specify a particular term.
The sentencing occurred around eight months after the initial seizure of the fireworks. The case is significant as it comes amidst several serious incidents involving ball bombs in Berlin on New Year's Eve of 2024/25. The defendant had expressed a desire to obtain a fireworks license in the past, but the court's ruling serves as a reminder of the importance of following legal procedures when dealing with dangerous substances.
