Immigration and Customs Enforcement (ICE) remains active in Lower Manhattan, with ongoing detainments, prompting advocates to assert that individuals are not receiving due legal process, or their day in court.
In the heart of Lower Manhattan, the immigration court at 26 Federal Plaza has become a house of turmoil and disruption. Court observer, Peter, has been witnessing this firsthand for an extended period.
Peter has personally witnessed a series of disturbing incidents, including pushings, kickings, and verbal abuse directed towards observers. He has also become accustomed to unpleasant treatment from ICE agents during his observations, with some instances of being threatened and even escorted out of the building for inquiring about a motion.
The increased presence of ICE operations last week has led to the arrest of more than 30 people. On Monday, two individuals were taken into custody after their hearings. One individual resisted the arrest procedure briefly before complying.
The trend of family separations and violent detentions has been ongoing for over three months, a period that has seen tensions rise between ICE agents and volunteers who attend hearings to offer support to immigrants. Attorneys and judges attempt to conduct hearings while immigrants are detained by ICE agents, a situation that has sparked demands for change from activists and lawyers.
Peter has expressed sympathy for the plight of immigrants trying to file for asylum, particularly those from dangerous nations. He emphasised the importance of everyone having their day in court, a principle he believes is not being upheld at 26 Federal Plaza.
Emma Kaplan of the Freedom Agenda has criticised Trump's deportation agenda, going so far as to compare the treatment of immigrants to concentration camps. Kaplan's concerns are shared by many, with over a dozen ICE agents seen roaming the hallways of the court during a visit on Sept. 8.
The demands of activists and lawyers regarding the rules and laws at the immigration court in 26 Federal Plaza are documented in public statements, legal petitions, and advocacy group reports related to immigration justice reforms. Observers have been relegated to waiting rooms due to escalating tensions and clashes.
Peter, along with many attorneys, claims that many of those arrested are working-class New Yorkers without criminal histories. This, coupled with the accounts of physical and verbal abuse, has led to widespread concern about the treatment of immigrants at 26 Federal Plaza.
The court, once a symbol of justice, has become a source of contention and disarray. As the situation continues to unfold, it remains to be seen how these concerns will be addressed and what changes, if any, will be made to ensure the principles of justice are upheld for all.
