Justice Department takes action against judge over Trump criticism

In a recent development, the United States Justice Department has filed a misconduct complaint against Chief US District Judge James Boasberg. The complaint alleges that Judge Boasberg made improper public comments about President Trump and his administration, which the Department of Justice (DOJ) claims undermined the integrity and impartiality of the judiciary.

The misconduct complaint, filed by Attorney General Pam Bondi through her chief of staff, Chad Mizelle, stems from comments Boasberg made during a closed-door meeting of the Judicial Conference, the federal judiciary's governing body, on March 11, 2025. There, he reportedly warned that the Trump administration might "disregard rulings of federal courts" and trigger a "constitutional crisis."

The DOJ asserts that these comments were an improper attempt to influence Chief Justice Roberts and other federal judges, that Boasberg had no factual basis for these claims, and that the administration has always complied with court orders.

In addition to these remarks, the complaint also references Boasberg's rulings in a high-profile case involving the deportation of Venezuelan migrants to El Salvador. Boasberg intervened by ordering planes carrying the migrants to return and later held hearings where he sharply criticized Justice Department attorneys for allegedly not following his orders and questioned whether the Trump administration was acting in good faith regarding due process for those deported.

Boasberg, who now serves as chief judge of the US District Court for the District of Columbia, has been presiding over a lawsuit brought by alleged Venezuelan gang members challenging their removal to the Terrorism Confinement Center, or CECOT. In an April ruling, he concluded the government had acted "in bad faith."

The filing escalates tensions between the Trump administration and the judiciary, with President Trump himself calling for Boasberg’s impeachment and labeling him "Crooked." However, legal experts and commentators have described the complaint as a rare and aggressive move but suggest the administration faces a difficult challenge proving judicial misconduct since Boasberg’s comments and rulings relate to his judicial capacity and efforts to uphold the rule of law.

It is important to note that Boasberg was first appointed by Republican President George W. Bush to the DC Superior Court in 2002 and later elevated to the federal bench by President Barack Obama in 2011. The Justice Department has also asked for the reassignment of the deportations case and possible disciplinary action, including a recommendation for impeachment if the allegations are substantiated.

Chief Justice Roberts defended judicial independence in response to Trump's call for Boasberg's impeachment. This case serves as a reminder of the crucial role the judiciary plays in maintaining the checks and balances within the US government. As the situation develops, it will be interesting to see how this dispute between the Trump administration and the judiciary unfolds.
