Lawsuit Filed by Jordan Neely's Father Over Alleged Wrongful Death Caused by Daniel Penny
In a recent development, the father of Jordan Neely, a homeless man who died following an incident on a New York City subway, has filed a wrongful death lawsuit against Daniel Penny, the 26-year-old student implicated in the incident.
The lawsuit alleges that Penny's negligence caused the incident, injuries, and ultimately, Neely's death. According to the complaint, on May 1st, Penny was riding the subway when Neely boarded the train and began threatening other passengers.
Penny, a U.S. Marine Corps veteran and current architecture student, is said to have put Neely into a chokehold, holding him until he lapsed into unconsciousness. Neely later passed away.
The attorney for Daniel Penny, however, believes that the potential consequences in the criminal trial are far greater than any civil suit could threaten. The attorney has also criticized the timing of the lawsuit, stating that the outcome of Penny's criminal trial should take precedence. As of now, Penny remains on trial for second-degree manslaughter and negligent homicide.
The incident has sparked racial injustice-related protests, with some activists criticizing what they believe to have been a disproportionate and inappropriate level of force used by Penny. The death of Jordan Neely has also raised questions about racial implications, as Penny is white and Neely was black.
Before the incident, Neely had been arrested dozens of times for theft and fare evasion. Reports also suggest that he had been implicated in assaults on at least three women. Neely had also threatened to kill several people, indicating that he was "ready to die" or go to jail for life.
It's worth noting that some people have called Penny a hero, while others have deemed the killing of Jordan Neely as unjustified. The case has undeniably widened political divisions, adding another layer of complexity to the already sensitive issue of racial justice.
Attorneys for Daniel Penny have not yet been served the complaint in the wrongful death lawsuit. The outcome of both the criminal trial and the civil lawsuit will undoubtedly have significant implications for all parties involved.
