Mandatory military service benefits Sweden but could potentially falter in Germany
Germany is set to introduce a new form of voluntary military service, a move that aims to strengthen the German Armed Forces. The German cabinet has approved a legislative package for this purpose.
The proposed changes are reminiscent of the voluntary military service model implemented in Sweden since 2017. However, unlike Sweden, the new German military service will not obligate young women to participate, but they can fill out the questionnaires if they wish.
If the Bundestag agrees, the law is expected to come into force on 1st January 2026. In preparation, around 11,000 people will be invited for a physical examination. Those who pass will be appointed as soldiers on active service.
The monthly net pay for the new military service in Germany is approximately 2,300 euros. Conscripts will also have access to language courses, individual training measures, accommodation, and health insurance. They will also be eligible for subsidies for obtaining a driver's license.
Complex military service legal constructions may be required to establish the new form of conscription in Germany. However, it's important to note that this does not necessitate a constitutional amendment but can be implemented through regular legislation.
The Conscription Act in Germany contains rules that reduce the number of recruitable young men, but allow 90% to be shown as conscription grades again. This is a testament to the intricate legal frameworks governing military service, often referred to as "complex military service legal constructions."
It's worth mentioning that a 2004 ruling by the Administrative Court of Cologne suspended conscription in the Rhineland due to insufficient participation. This historical context underscores the need for a change in the law to reverse the suspension of conscription from 2011.
Defense Minister, Boris Pistorius, described the draft for the introduction of a new military service as a "huge step forward." The Swedish model, where men and women born from the 2000 cohort are required to fill out a questionnaire on motivation, skills, and interests, might serve as a guiding principle. Men from the 2008 cohort will have to fill out a questionnaire indicating whether they are fit and willing to serve in the military from 1st January 2026 onwards.
In the Swedish model, volunteers can choose their service time flexibly, ranging from six to 23 months. This adaptability might be a feature that the new German military service also considers.
The introduction of a voluntary military service in Germany represents a significant shift in military policy. As the details unfold, it will be interesting to see how this change is received and how it will impact the German Armed Forces.
