In a significant turn of events, the Higher Administrative Court in Kassel has overturned the ban on the "United4Gaza - Stop the genocide now!" rally, scheduled to take place in Frankfurt, Germany, on August 30th. The demonstration, which is expected to attract up to 5,000 people, was initially prohibited due to fears of a "potentially anti-Semitic assembly" and the risk of an "escalation spiral" in the current "extremely tense atmosphere" between pro-Palestinian and pro-Israeli activists.

The court's decision, made on Thursday, was a confirmation of a decision made by the Frankfurt Administrative Court. The ruling allows for the rally to proceed, with the police having the authority to target individual troublemakers to maintain peace. The march will start from the Harbor Park and proceed through the heart of Frankfurt, between 3:00 PM and 9:00 PM.

The organizer filed an urgent application with the Frankfurt Administrative Court, arguing that the ban was unwarranted. The court's reasoning states that the police can focus on individual troublemakers to ensure the right to assembly for other participants. The court also stated that an assessment of opinions protected by Article 5 GG is not the task of state authorities.

The court's decision was made in response to the city's concerns about increased emotionalization and potential violence related to the Middle East conflict. However, the court determined that an immediate threat to public safety is necessary for a ban to be imposed, and such a threat was not evident in this case.

The public assembly office in Frankfurt's public order department had prohibited the demo on Wednesday. But with the overturning of the ban, the "United4Gaza" rally has been given the green light. The court's ruling was a confirmation of a decision made by the Frankfurt Administrative Court, ensuring that the demonstration can proceed peacefully.
