In a recent turn of events, independent creator Kelley Heyer has resolved her lawsuit against the Roblox Corporation. The lawsuit was centred around an in-game emote based on Heyer's viral dance to Charli XCX's song Apple.

The Apple dance, a huge TikTok trend in summer 2024, was adopted by Charli XCX herself and was incorporated into a Brat update for the Roblox game Dress to Impress. Heyer subsequently copyrighted the dance, claiming she should be compensated fairly for her work.

Roblox is reported to have made around $123,000 from selling the emote between August and November 2024, according to the lawsuit. However, there is no publicly available information about the exact amount Heyer received from Roblox Corporation regarding the licensing of the apple dance.

Interestingly, Heyer is not the first viral dance creator to bring a suit against games. Alfonso Ribeiro, the actor behind the Fresh Prince of Bel Air's 'Carlton Dance', sued Epic Games as far back as 2019. 2 Milly, the creator of the Milly Rock, and Backpack Kid (the Floss) are among others who have followed suit. Orange Shirt Kid, the creator of the Orange Justice, is another notable example.

In a statement, Heyer expressed her satisfaction with the talks she had with the Fortnite team, stating that they were "really wonderful and super easy to work with." She also performed the dance live at one of Charli XCX's concerts, further solidifying her connection to the dance.

Rich Stanton, a games journalist with 15 years' experience, provided insight into the legalities surrounding the dance. Stanton, who has worked for a wide range of outlets and is the author of "A Brief History of Video Games," noted that this is not an isolated incident. Heyer's lawsuit against Roblox Corporation is just one of many cases where viral dance creators are seeking fair compensation for their work.

The parties involved in the lawsuit have released a short statement expressing their wishes for each other's success in their creative pursuits. The resolution of this lawsuit marks a significant step forward in the ongoing conversation about fair compensation for creators in the gaming industry.
