In a recent decision, the appellate court in Chita has adjusted the ruling made by the Central District Court, modifying the fine and moral damage compensation imposed on LLC "KARI" in a dispute over unused gift certificates.

The initial ruling, made in favour of a local resident, required LLC "KARI" to refund 116,000 rubles for 24 gift certificates worth over 100,000 rubles that the resident was unable to use. The court also ordered the company to pay a fine of 70,500 rubles and compensate for moral damages amounting to 25,000 rubles.

However, LLC "KARI" filed an appeal, questioning the fact of the plaintiff's purchase of the certificates and the justification of the moral damage compensation amount. As a result, the appellate court has reduced the fine to 63,000 rubles and adjusted the moral damage compensation to 10,000 rubles.

Despite the adjustments, the appellate court did not overturn the initial ruling that LLC "KARI" should refund the gift certificates to the resident. The company had already returned the 116,000 rubles to the plaintiff before the appellate court hearing.

The plaintiff's family faced hardship due to the inability to use the gift certificates, with the family being forced to wear summer shoes all winter. The case serves as a reminder for businesses to ensure their customers are satisfied with their purchases and to handle returns promptly.

The appellate court's decision in this case highlights the importance of due process and the ability for parties to appeal rulings they believe to be unfair or unjust. The case is now closed, but it serves as a valuable lesson for businesses and consumers alike in the importance of clear communication and customer satisfaction.
