Suing Trump: Individual Brings Legal Action Against the Former President
In the tumultuous political landscape of 2026, the American Civil Liberties Union (ACLU) continues to be a beacon of resistance against controversial immigration policies under the Trump administration.
Ben Wizner, director of the ACLU's Speech, Privacy, and Technology Project, sits in a modest office adorned with a map of Washington, D.C. as a state. Wizner, who has been one of the most vocal opponents of Donald Trump for months, if not years, is at the forefront of the fight.
The ACLU advises people without passports to know their rights and to read their materials "Know Your Rights" for guidance in different situations. In a significant move, the organisation has filed 79 lawsuits against the Trump administration since 2025.
One such case involves Mahmoud Khalil, a Palestinian activist and graduate of Columbia University. Despite a federal court declaring his detention unconstitutional, the Trump administration is pursuing legal action to deport him. Khalil's permanent residence permit was revoked without a proper procedure, and he was not accused of any crime. The ACLU, along with other organisations, is working to prevent Khalil's deportation.
The government's claim that they can search homes without a warrant under the "Alien Enemies Act" of 1798, used by Trump to deport individuals without trial, was also stopped by the courts. The ACLU is also suing against the practice of deporting immigrants from courtrooms.
The issue of Sanctuary Cities, which do not cooperate with the federal government on immigration matters, has become a contentious topic. Critics argue that these cities are breaking the law themselves, but the ACLU's stance is that they are standing up for the rights of their residents.
Protests against Trump are increasing, with more than five million people at the No-Kings protests and protests against politicians in town halls. The executive order aimed at repealing the 14th Amendment, which guarantees birthright citizenship, was blocked by the courts.
Trump's popularity is sinking, with approval ratings below 40 percent, and even on immigration, a majority disapproves of his policies. The USA is not a civil war country, and the idea that armed citizens could keep a heavily armed surveillance state in check is laughable.
Democracy must be defended every day, and the coming year 2026, with the mid-terms, will be decisive. The government sees residence permits as a privilege, not a right, and has arrested people for their political expressions. In 75% of the cases where the ACLU has sought a preliminary injunction against the government, they have succeeded.
As the political landscape continues to evolve, the ACLU remains steadfast in its mission to defend the rights and liberties of all individuals, regardless of their immigration status.
