Supreme Court Petition for Cerdán's Release After 70-Day Incarceration for Unbounded Investigation
Santos Cerdán, former PSOE Organization Secretary, has requested freedom from preventive detention after 70 days, following an investigation into an alleged bribery scheme involving public works contracts. The request was made to the Supreme Court on Monday.
Cerdán is under investigation for his alleged involvement in the scheme, and he has expressed concerns about the evidence against him. He questions the recordings of Koldo Garcia, former advisor to former Minister of Transport José Luis Ábalos, as they were allegedly made under police direction. If Garcia made the recordings, they would be null evidence, he argues.
Moreover, Cerdán has criticized the "agreed and openly false" character of the declaration made by Víctor de Aldama, a key figure in the investigation. He has requested an investigation into the existence of the "K fontanería" chat by the Information Service of the Civil Guard dependent on Commander Rúben Villalba.
The defense argues that the judicial process is "strongly process-tensioned". They claim that the legal timeframe for the investigation has been exceeded without evidence. Cerdán has also requested the delivery of all expurgated or declared secret material from the Civil Guard, and all pending reports related to him from the Civil Guard.
The Supreme Court believes there is a risk of destruction and alteration of evidence, manipulation of witnesses, and movement of possible hidden funds in the alleged bribery scheme. Cerdán has requested the summoning of several Civil Guard agents involved in the investigation, including Commander Villalba, to determine possible instructions received in prison to direct his declaration.
The Constitutional Court will analyze the habeas corpus appeal filed by Cerdán against his provisional imprisonment this week. If the court rules in his favour, Cerdán could be released from prison. The origins of these recordings are not recorded in this procedure, according to Cerdán, adding to his concerns about the evidence against him.
