Tesla Cybertruck Owner Expresses Disappointment as Authorities Decline to Arrest 16-Year-Old Vandalizer - Owner laments, "He's a Minor, but I Wish He Faced Consequences and Spent Time in Jail"
David Bayes, a resident of Las Vegas and proud owner of a Tesla Cybertruck, recently found his vehicle vandalized by a 16-year-old perpetrator. The incident occurred a few months ago, and Bayes shared his experience on the Tesla Cybertruck Owners group on Facebook.
The vandalism was caught on camera, and Bayes took immediate action. He managed to get the vandal's name, phone number, and reported the incident to the authorities. Despite the vandal's unrepentant attitude, Bayes is concerned about the possibility of his Cybertruck being vandalized again.
In California, where the incident took place, the cap for small claims court has been raised to $10,000 or $12,000. Experts such as J.S. Raggmann and James Muenda Cole suggest pursuing a small claims court case to recover some of the money spent on repairs. Recoverable damages in small claims court include the damages, filing fees, and service fees.
However, since the suspect is a minor, authorities will not make any effort to find and arrest him unless he commits another offense. This has led some, including fellow Cybertruck owner Tony Arellano, to suggest suing the suspect's parents for damages.
Robert Jones, an expert in juvenile law, explains that if the minor is a Texas resident, it might be possible to sue the parents for damages. In Texas, there is a statutory cap of $25,000 in damages plus costs and fees for suing a minor's parents.
In Fremont, California, the parents of the 16-year-old perpetrator live, though their names have not been publicly disclosed. Parents can be held responsible through negligent supervision or by court-ordered restitution in the juvenile's criminal case.
Filing in many places is now done online in small claims court, making it easier for Bayes to take legal action. Bayes, during the confrontation with the vandal, kept a safe distance, ensuring his safety.
As Bayes continues to navigate the legal process, he hopes that his experience serves as a reminder for other Cybertruck owners to be vigilant and consider seeking legal recourse in the event of vandalism.
