The Court consistently rules that the Commission's inaction alone does not warrant the levying of a penalty.

On August 26, 2025, a significant traffic accident occurred on the A23 highway near Dägeling. The incident, which took place shortly before the Itzehoe-Süd exit at approximately 17:43, involved three passenger cars.

The accident resulted in two individuals being hospitalized with serious injuries. The 51-year-old driver of the leading vehicle was airlifted to a hospital, where doctors could not rule out life-threatening injuries the following morning. The 50-year-old passenger from the same vehicle also sustained serious injuries. Thankfully, the driver of the third vehicle was unharmed.

The 64-year-old man from Büsum, who was driving one of the vehicles, sustained minor injuries. The police have initiated a criminal investigation against him for reckless bodily harm.

The A23 was closed in the direction of Heide until 21:00 due to the accident investigation. The Itzehoe Public Prosecutor's Office has taken over the investigation, with the Elmshorn Police Highway and District Office handling the initial investigation.
