Twitter's X Profile Decisions from The Federal Labor-Management Relations Program Continues
President Donald J. Trump has issued an amended Executive Order on August 28, 2025, aimed at enhancing national security. The order, which builds upon Executive Order 12171, outlines several key changes.
The amended order determines certain agencies and agency subdivisions to have primary functions in intelligence, counterintelligence, investigative, or national security work. However, the specific agencies and subunits exempted from the provisions of Chapter 71 of the United States Code due to national security requirements and considerations are not detailed in the available search results.
The order is to be implemented consistently with applicable law and subject to the availability of appropriations. It is important to note that Section 71 of title 5, United States Code, cannot be applied to these agencies and subdivisions in a manner consistent with national security requirements and considerations.
The order also extends the deadline for orders published by the Secretaries of Defense and Veterans Affairs under Executive Order 14251. Additionally, Section 4 of the order states that if any provision is held to be invalid, the remainder of the order will not be affected.
Section 3 of the order further revised Executive Order 12171, with the inclusion of the International Trade Administration, the Office of the Commissioner for Patents and subordinate units, Patent and Trademark Office, the National Environmental Satellite, Data, and Information Service, and the National Weather Service as agencies or subdivisions of the Department of Commerce.
The United States Agency for Global Media is also included in the Executive Order. Moreover, a new section has been added after section 1-411 of Executive Order 12171, but no specific details are provided in the paragraph.
A new exception has been added to section 1-408 of Executive Order 12171 for units in the Bureau of Reclamation with primary responsibility for operating, managing, or maintaining hydropower facilities.
It is worth mentioning that the order does not create any right or benefit enforceable at law or in equity by any party. Furthermore, Section 5(a)(ii) of the order does not affect the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.
Lastly, Section 5(a)(i) of the order does not affect the authority granted by law to an executive department or agency, or the head thereof. The order issued prior to 15 days from the date of this order will have full force and effect, despite section 4(b)(ii) of Executive Order 14251.
