Unlawful search conducted on Juso chairwoman due to controversial graffiti by Merz - Unlawful Infiltration: Merz-Graffito Performs Unauthorized Search in Juso Headquarters
In the small town of Menden, located in Sauerland, a series of politically motivated graffiti attacks against Friedrich Merz, a prominent German politician, have sparked a legal controversy. The focus of this controversy is not Merz himself, but Juso chairwoman Nela Kruschinski, who is a member of the youth organization of the German Social Democratic Party (SPD).
The graffiti attacks, which appeared a few weeks before Merz's appearance in Menden-Huingsen on January 26, included slogans such as "Shut Merz up" and "Antifa on the offensive." The city was shaken when the home of Juso local chair Kruschinski was raided by police in early April.
The search warrant against Kruschinski was approved by the Arnsberg Local Court, where Charlotte Merz, Director of Arnsberg Local Court, is the chair. However, it was later deemed illegal by the Arnsberg Regional Court. The court's decision was based on a lack of documentation of the Public Prosecutor's Office application and questionable transmission of the stated intention to make such an application.
The search warrant was based on two pieces of information: a vague observation by a witness who could not identify Kruschinski and another individual. The note received by police targeted Kruschinski and her acquaintance, but no concrete information was provided, and the sender's identity remains unknown.
The Arnsberg Public Prosecutor's Office suspected Kruschinski of being responsible for several politically motivated graffiti attacks against Friedrich Merz and the CDU. However, investigations by the WDR magazine "Westpol" found no solid evidence against Kruschinski.
The judge of the Arnsberg Amtsgericht, who issued the search warrant against the Juso chairwoman, was influenced neither openly nor officially. However, concerns about potential conflicts of interest and procedural irregularities arose due to the court director being the wife of Friedrich Merz, and a police officer involved in the investigation being a CDU member and part of the board of the shooting club whose premises were vandalized.
Two days after the raid, Kruschinski filed a complaint against the search warrant. Her laptop, phone, and several notebooks were seized during the raid, but their examination has not led to any incriminating evidence.
Despite the controversy, it is important to note that Friedrich Merz is not involved in the search warrant controversy. He was the target of the politically motivated graffiti attacks, but he is not under investigation in connection with these incidents.
As the investigation continues, the citizens of Menden and the political community await the outcome of this complex case, hoping for a resolution that upholds the principles of justice and fairness.
